01Nature of the activity
Resistance training, corrective exercise, and rehabilitation exercises carry an inherent risk of injury, including but not limited to muscle strains, joint injuries, and, rarely, more serious harm. This is true whether you're following our videos independently, a plan built for you through Training Customization, or guidance from a 1-on-1 consultation.
02Assumption of risk
By using our courses, app, or Work With Me services, you voluntarily choose to participate in physical training and accept the risks that come with it. You confirm you're in adequate physical condition to participate, or have checked with a doctor if you're unsure.
03Not a substitute for professional care
Our content, including anything assigned to you through Training Customization or discussed on a call, is educational and general in nature. It's not medical advice, physical therapy, or a substitute for in-person evaluation, diagnosis, or treatment by a qualified professional.
04How to approach rehab content
For minor issues: you can safely follow the instructional videos for minor aches, or to improve localized mobility and stability in specific body parts.
For serious or chronic injuries: do not use this content without professional guidance if you're dealing with severe, long-term, or complex injuries, whether they came from a sudden accident or gradual wear-and-tear.
Important: if you fall into the second category, you must undergo a proper clinical assessment and kinetic diagnosis, a professional evaluation of how your body moves, before attempting any of these exercises. For the rehab track of Training Customization specifically, we require you to already have this assessment before we'll build your plan.
05Red-flag symptoms: stop and seek care
Stop training and see a medical professional right away if you experience:
- Numbness or tingling
- Weakness, or a joint giving way
- Pain that wakes you at night
- Any change in bladder or bowel function
These can be signs of something that needs urgent in-person evaluation, not a training plan.
06Accuracy of the information you provide
Any plan we build or feedback we give is only as good as the information you give us. You confirm that the goals, history, pain levels, and any assessment or diagnosis details you submit are accurate and complete to the best of your knowledge.
07Footage and documents you submit
If you submit video footage or documents, including a link to an assessment or diagnosis, you confirm you have the right to share them, and you consent to Jeff reviewing them for the purpose of evaluating your form, program, or condition, as described in our Privacy Policy.
08Your equipment and environment
You're responsible for training in a safe environment, using equipment that's in good condition, and stopping if something doesn't feel right. We don't inspect or guarantee the safety of any gym, equipment, or space you choose to train in.
09Release of liability
To the fullest extent permitted by law, you release No BS Academy and Jeff from liability for injury, loss, or damage arising from your participation in our training or rehab content, except where caused by gross negligence or willful misconduct. This release doesn't apply where the law doesn't allow it, including in jurisdictions that limit or prohibit waivers for certain types of harm.
10Minors
If you're between 13 and 17, a parent or legal guardian must review and agree to this waiver on your behalf, and should supervise your training.
11Governing law
This waiver is governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles, except where local law gives you rights that can't be waived. Any disputes shall be resolved in the courts of the State of Wyoming.
12Acknowledgment
By checking the consent box on our forms, or by using our training or rehab content, you confirm that you've read, understood, and agree to this Client Waiver.
